TERMS AND CONDITIONS
Agreement between Texas Webworks and [Your Name] (the “Customer”)
The Customer is subject to the following terms and conditions:

Services

Texas Webworks will provide all necessary services to the Customer to create and/or modify an existing website, create logos, graphics or print items. Texas Webworks will make available all knowledge, information and expertise to perform said services to the Customer.

Client Obligations

Texas Webworks requests that all photos, copy and web content be supplied by the Customer via email fax, or mail within a reasonable amount of time after agreement is made. The Customer will work with Texas Webworks in order to complete project in a timely manner. If Customer is not available to Texas Webworks when needed Texas Webworks will not be held responsible for delays to the completion of the project.

Project Consideration

Please note that Texas Webworks is a family owned and operated company. Therefore, we will not accept projects that we find morally questionable, unethical, or distasteful.

Progress Reports and Commutation

Texas Webworks is available via email at all times if the Customer has any questions concerning the project. Texas Webworks will inform the Customer of any problems that may delay the project.

Proofing of Final Project

Texas Webworks will post all site work done to our server for review by the Customer. This will allow the Customer an opportunity to review the appearance and content of scripted material. If the Customer request changes outside the limits of original contract, the Customer agrees to pay Texas Webworks web design fees on a per hour basis. Upon final proofing of the project the Customer will notify Texas Webworks. At that time final payment of the fee balance will then be due. Once final payment has been received by Texas Webworks the project will be loaded to the Customers hosting server.

Payment Terms

A $150.00 non-refundable deposit is required when Texas Webworks and the Customer have an agreement set in place and a signed or verbal approval is given to proceed. Once the final design has been approved by the Customer the remaining balance is due before project goes live. Payments may be made via US mail or the preferred method of payment is through the Texas Webworks web site. Payments made on the Texas Webworks may be made with Visa, MasterCard, American Express, Discover and e-Checks through Pay Pal.

Confidentiality

All correspondence and documents provided will be treated as confidential between the Customer and Texas Webworks. Texas Webworks will not disclose to any third party any information obtained from the Customer.

Copyright

The Customer guarantees that any graphics, text, designs or any other information submitted to Texas Webworks for the fulfillment of this agreement are owned by the Customer, or that the Customer has permission to use them. By agreeing to these terms and conditions, the Customer removes the legal responsibility of Texas Webworks and any claims or legal actions however related to the content of the Customers site. Texas Webworks reserves the right to display websites and graphics that have been designed by Texas Webworks on their website, and in any marketing material to aid as examples of our work.

Upon completion of the project, Texas Webworks transfers all rights and ownership of CUSTOM designs, templates and programming written by Texas Webworks to the Customer. Software and third party graphics or programs are not transferred to the Customer and remain under copyright of their respective owners.

Credit

All projects will include a small credit link back to Texas Webworks. The Customer guarantees that the credit and link back will not be removed or modified. Credit will be displayed as: Site Design by Texas Webworks and will be displayed at the very bottom of the site pages.

Maintenance

Texas Webworks will provide one month of minor changes to the Customers website after it has been completed. After that time any updates or modifications to the Customers site will be performed at our hourly rate for website maintenance or updates is $50.00 an hour, with a 30 minute minimum per update.

Acceptance

Please note that by submitting your deposit for our services you are agreeing to all of our terms & conditions as written here. Texas Webworks reserves the right to change or update these terms at any time without prior notice.
